第45卷第 14期 2018年7月 建筑管理 Building Management 建 筑 技 术 开 发 Building Technology Development 市 政 工 程 总 承 包 合 同 管 理 与 实 践 姜 鸿 (上 海 市城 市建设 设 计研 究总 院 (集 团 )有 限公 司 ，上 海 200125) [摘 要]总结工程总承包模式在我国的应用现状及工程总承包合同的特点，介绍总承包合同管理的一般程序，并结合所在 单位承接的市政3-程总承包项 目的具体实践过程中出现的问题，对市政工程总承包项 目合同执行的重难点进行 了分析总结，提 出了相应的合同管理经验，可供类似的项 目的合同管理工作借鉴。 [关键词 ]市政工程 ；工程总承包 ；合同管理 [中图分类号 ]TL372 [文献标志码 ]A [文章编号 ]1001—523X (2018)14~0072—03 M anagem ent and Practice of G eneral Contract Contract f0r M unicipal Engineering Jiang Hong [Abstract]The urgent requirement of the work unit．This paper sums up the application status of the general contract mode in China and the characteristics of the general contract of the project，introduces the general procedure of the management of the general contract，and combines the problems in the concrete practice of the general contracting project of the municipal engineering contracted by the unit in which the unit is undertaken，and the heavy and difficult points in the execution of the general contract of the municipal engineering contract．Based on the analysis and summary，the corresponding contract management experience is put forward，which has a certain reference significance for the contract management of similar municipal general contracting projects． [Keywords]municipal engineering；general contracting；contract management 1 工程总承包的现状 工程总承包模式在我国的应用始于20世纪8O年代，并 已 从化工、石化行业逐步扩展至冶金、电力、铁道、石油天然气、 水利、建材等行业。目前，在建筑工程、市政工程行业 中工 程 总承包模式也得到了大力推广。市政基础设施建设主要使 用政府财力资金，工程竣工后对建设单位而言，有基于各分 项合 同的项 目结算，也有政府对财政资金使用情况的项 目审 计。工程总承包合同及其管理的法律基础，与各阶段分别实 施的项 目相同，主要包括国家或地方颁发的法律及行业主管 部门发布的管理规范。 2 工程总承包合同的特点 工程总承包可以更加有效的控制工程成本与进度，提升 项 目完成质量。工程总承包合同一般采用总价合同，合同范 围内基本不用再支付索赔及签证费用，项 目的最终价格和要 求的工期具有更大程度的确定性。对于承包商而言，业主介 入项 目的程度低，总承包商有更多的 自主权，有利于充分发 挥总承包商的主观能动性。总承包商负责项 目的全过程或若 干阶段，有利于保证工程建设各环节的连续性，减少责任盲 区，有利于控制项 目进度和成本，确保业主既定项 目总 目标 实现。 工程总承包合同结构简单，责任分配更加明确。工程总承 包合同价格不仅包括勘察费、设计费与施工费，根据双方合 同约定情况，还可能包括设备购置 费、总承包管理费、专利 转让费、研究试验费等。与勘察设计施工分别发包的模式相比， 发包人将勘察、设计与施工范围内的工作委托给一个总承包 人负责，发包人的组织和协调工作量少，工程质量事故责任 明确，一旦有不 良事故发生，可减少业主和承包商之间的纠纷。 3
